We are experienced in acting in cases where disputes are resolved by arbitration, expert determination and mediation.

Arbitration and Expert Determination

Cases where we have been instructed to act as Arbitrator or to undertake Expert Determination include:

  • Acting as Arbitrator in connection with a minority shareholder dispute in respect of an IT software company. The appointment involved both formal hearings and written awards.

  • Being appointed by the institute of Chartered Accountants under the President's Appointment Scheme to determine the final proceeds payable in respect of a publishing group pursuant to the business sale agreement between the parties.

  • Accepting appointment from the President of the ICAEW in connection with a dispute surrounding the completion accounts of a clothing manufacturer following the sale of the company.

  • Being appointed as the appointed expert by the parties to determine the valuation of a group of specialist PR companies in accordance with the compromise agreement entered into between the holding company and the leaving managing director/ founding shareholder.

Mediation

Due to the cost and protracted nature of litigation, parties are increasingly attempting to settle disputes through mediation.

The Forensic Accounting team at Vantis is experienced in assisting the legal team during the mediation process, including preparing calculations and assisting in drafting submissions in advance of the mediation as well as attending the mediation to provide accounting support and, if appropriate, meet with opposing experts.
